Combating Insurance Fraud: New Legislation Could Save Kansans Money

Gavel being hit

Insurance fraud continues to be a significant issue across Kansas, costing residents an estimated $1,000 annually. These fraudulent activities, such as staged car accidents, inflated medical bills, and false property damage claims, not only increase premiums but also burden the resources of insurance companies and law enforcement agencies alike.

Currently, insurance fraud is prosecuted exclusively as a criminal offense. While this approach has its merits, it often limits the tools available to effectively address the full scope of fraudulent activities. Recognizing this challenge, the Kansas Department of Insurance is taking proactive steps to strengthen its fight against insurance fraud by introducing new legislation.

This proposed legislation aims to create civil penalties for insurance fraud crimes. By doing so, the Department will be able to pursue cases of fraud through a civil process in addition to the existing criminal statutes. This dual approach will enhance enforcement capabilities, deter fraudulent behavior, and potentially lead to cost savings for honest policyholders. It also provides an additional avenue for restitution to victims of fraud.

The introduction of civil penalties provides the Department with a more flexible and efficient framework for addressing fraudulent activities. Unlike criminal proceedings, which require a higher burden of proof and extensive resources, civil cases can often be resolved more quickly and with fewer hurdles. This means faster accountability for perpetrators and reduced financial losses for insurance companies—savings that could ultimately benefit policyholders through stabilized or lower premiums.

As these efforts move forward, they represent a commitment to protecting Kansans and their hard-earned dollars from the damaging effects of insurance fraud. By equipping the Department of Insurance with these additional tools, the state is taking a significant step toward a fairer and more transparent insurance marketplace.

We encourage you to contact your state representatives to express your support for this important legislation. By working together, we can help combat insurance fraud and ensure a more secure future for all Kansans. Stay tuned for updates on this important legislation and what it means for you as a policyholder.
